The Ministry of Environment, Forest, and Climate Change (MoEF&CC) has established comprehensive rules under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (HOWM Rules, 2016) to ensure the environmentally safe handling of hazardous waste. These regulations are enforced under the Environment (Protection) Act, 1986, aiming to safeguard human health and the environment from adverse impacts.

Key Provisions of HOWM Rules, 2016
- Regulated Import of Hazardous Waste
- The import of hazardous waste listed under Part A of Schedule III is permitted for recycling, recovery, reuse, and co-processing.
- Hazardous waste import is prohibited for disposal in India.
- Import Permissions and Licensing
- Only actual users with valid permissions from MoEF&CC and the Directorate General of Foreign Trade (DGFT) are authorized to import hazardous waste.
- Illegal Import of Hazardous Waste
- Any import without MoEF&CC’s approval is treated as illegal.
- Ports and Customs Authorities are responsible for taking action against violators under the Indian Ports Act, 1908 or the Customs Act, 1962.
Annual Inventory Data on Hazardous Waste Imports
As per the annual inventory submitted by State Pollution Control Boards (SPCBs) and Pollution Control Committees (PCCs):
- Total Import: 5.47 lakh MT of hazardous waste was imported by entities in 10 states.
- Key States Involved: Andhra Pradesh, Bihar, Gujarat, Jammu & Kashmir, Karnataka, Madhya Pradesh, Punjab, Rajasthan, Tamil Nadu, and West Bengal.
Role of SPCBs and PCC
SPCBs and PCCs are entrusted with the following responsibilities under the HOWM Rules, 2016:
- Authorization Management: Granting and renewing authorizations for waste management.
- Compliance Monitoring: Ensuring adherence to the provisions of HOWM Rules.
- Violation Enforcement: Taking action against rule violations.
